How to Handle Harassment Claims Under the New EEOC Guidance. The EEOC recently issued new guidance regarding when employers should be held liable for workplace harassment. This presentation will discuss the new guidance, and how companies should update their harassment policies and procedures.

Wait . . . Am I An Employer? A Look at the Changing Rules Surrounding Independent Contractors and Joint Employers. This presentation will look at when an employer is, in fact, an employer and the factors considered by courts in assessing whether a worker is an employee or independent contractor. We will also consider the recent NLRB rule expanding the scope of employers that may be considered joint employers, the Texas federal court decision that struck the rule down, and the current status of joint employment as a result.

Complying With the Pregnant Workers Fairness Act (and other accommodation obligations). This presentation covers the Final Rule issued by the Equal Employment Opportunity Commission (EEOC) regarding employer responsibilities under the Pregnant Workers Fairness Act (PWFA), which comes into effect on June 18, 2024. The PWFA outlines employers' duties to provide reasonable accommodations to qualified employees and job applicants with limitations due to pregnancy, childbirth, or related medical conditions. This session will guide employers on how to meet these accommodation requirements and will also explain how the PWFA differs from or aligns with the accommodation requirements of the Americans with Disabilities Act (ADA) and Title VII.
